Terms of Service

This policy applies to all individuals and businesses utilizing the services provided by Host Prestige. This is designed to protect the security, integrity, reliability, and privacy of the services Host Prestige offers to its customers. Host Prestige reserves the right to modify this policy at any time, effective immediately upon posting of the modification. Your use of Host Prestige's services institutes your acceptance of the policy in effect at the time of your use.

Prohibited Content and Usage

The services provided by Host Prestige may be used for legal purposes only. The use of our services to transmit or store any material that is illegal or in support of illegal activities is strictly forbidden. Material and activity that is not allowed on our servers include, but is not limited to:

  • Material in violation of any local, state, federal, or non-United States law or regulation, including rights protected by copyright, trade secret, patent or other intellectual property or similar laws or regulations.
  • Material that is threatening or abusive, obscene, indecent, or defamatory.
  • Installation or distribution of "pirated" or other software products that are not appropriately licensed for use by customer.
  • Deceptive marketing practices.
  • Actions that restrict or inhibit anyone in his or her use of Host Prestige's services, or that generate excessive network traffic through the use of automated or manual routines that are not related to ordinary personal or business use of services.
  • Introduction of malicious programs (viruses, trojan horses and worms) into the network or servers.
  • Causing or attempting to cause security breaches, including but not limited to, accessing data of which the customer is not an intended recipient, or logging into a server or account that the customer is not expressly authorized to access.
  • Causing or attempting to cause security disruptions, including, but not limited to, port scans, flood pings, packet spoofing and forged routing information. This means no IRC on the network.
  • Executing any form of network monitoring that will intercept data not intended for the customer.
  • Circumventing user authentication or security of any account.
  • Interfering with or denying service to any user (denial of service attack).
  • Using any program/script/command, or sending messages of any kind, designed to interfere with, or to disable a user's terminal session.
  • Furnishing false or incorrect data on the order form contract including fraudulent use of credit card numbers or attempting to circumvent or alter the processes or procedures to measure time, bandwidth utilization or other methods to document "use" of Host Prestige's services.
  • Sending unsolicited mail messages (spam), including the sending of "junk mail" or other advertising material to individuals who did not specifically request such material, who were not previous customers of the customer or with whom the customer does not have an existing business relationship.
  • Harassment, whether through language, frequency, or size of messages.
  • Unauthorized use or forging of mail header information.
  • Solicitations of mail or any other e-mail address other than that of the poster's account or service, with the intent to harass or collect replies.
  • Creating or forwarding "chain letters" or other "pyramid schemes" of any type.
  • Exporting, re-exporting, or permitting downloads of any content in violation of the export or import laws of the United States or without all required approvals, licenses and exemptions.

Host Prestige reserves the right to deactivate and remove any web site from its servers which contains material that is deemed to be unacceptable, offensive, or objectionable.

Banned Scripts

You are prohibited to use or install the following scripts on your account due to security holes and resource usage issues:

  • Greymatter
  • YaBB Message Board
  • Ikonboard Message Board
  • Formmail (cgi, pl)

You are solely responsible for any and all acts and omissions that occur during or relating to your use of the service, and you agree not to engage in any unacceptable use of the service. You will be held responsible and accountable for any activity by third parties using your account. You are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account.

For security purposes, all communication regarding account related matters and problems are limited to the account holder. If you need to appoint a third party to manage your account, you are required to send us an authorization message stating so.

Resource Usage

Each account is given a clearly defined amount of resources including disk space and data transfer. When an account uses more resources than has been allocated, the account will be temporarily suspended. If the resource abuse is excessive, Host Prestige reserves the right to deactivate the account pending client cooperation and resolution.

Any account that affects the normal operation of any of the services provided by Host Prestige including, but not limited to, administrative tasks, MySQL Services, server access, network speed, content or email delivery, may be deactivated without notice in an effort to restore normal operations.

In the event of account deactivation, Host Prestige remains the final authority in determining whether or not the account will be reactivated. The severity of the violation, as well as the account holder's cooperation and ability to prevent future violations, will be considered when determining whether or not the account will be reactivated.

Contact Information

It is your responsibility to update your contact information accordingly. Host Prestige reserves the right to suspend or terminate accounts of clients that cannot be reached due to invalid contact information. You may update your contact information either by sending us an email or updating it through your domain manager and/or cPanel.

Technical Support

The technical support provided by Host Prestige covers issues related to the server, server operation, and the server software being used. We will offer assistance and advice if it falls within our area of expertise, but it does not extend to physically doing custom programming, script debugging, troubleshooting third party software, or anything not directly related to our web hosting services. A reasonable fee may be charged for services that are not part of our standard support.

Payments and Billing

Payment, in part or in full, depending on the agreement, is expected before services will be rendered, unless otherwise agreed upon beforehand. If an automatic payment subscription is not present, notifications will be sent one (1) month before due date for domain name services, and one (1) week before due date for web hosting services, unless requested otherwise. You are expected to make your payment on or before the due date. If you do not pay by this time we will suspend your account until you settle your balance or email us saying that you would like to cancel. If we do not hear from you in 14 days we will terminate your account completely.

Bounced checks are subject to a $5 fee, so please make certain that your account has funds when you send in your payment. All credit card purchases are subject to fraud verification before acceptance. 2Checkout.com, Inc. is an authorized retailer of Host Prestige.

Cancellation and Refunds

You must notify Host Prestige in writing at least three (3) days prior to cancellation if you'd like to cancel your account. Simply not using your account anymore will not automatically remove you from an automatic payment subscription, if present. Refunds for services that are provided but not used will be denied.

Our web hosting packages carry a 14-day money back guarantee. If you are not satisfied with our services, simply send a request to support@hostprestige.net for a refund. Please include your domain name, username, password, and reason for requesting this refund. We do not tolerate 'Host Jumpers' who move from host to host monthly, requesting money back guarantee refunds. If you are found to be hosting with us for this purpose, the 14-day money back guarantee is void. Requests for a refund after 14 days of your account will be denied. Domain registration fees are also non-refundable. Accounts that have been suspended or terminated due to violation of our terms of service are not eligible for refunds.
